Gegenstand dieser Untersuchung ist das Kernproblem der juristischen Methodenlehre. Es läßt sich in der Frage formulieren, ob die Jurisprudenz über einen konsensfähigen Regelkanon verfügt, der eine rationale und intersubjektiv prüfbare Kontrolle juristischer Entscheidungstätigkeit ermöglicht. Einigkeit besteht heute im wesentlichen nur im Negativen, nämlich darin, daß das juristische Entscheiden nicht allein durch Gesetz, Präjudiz, Dogmatik und herkömmlich juristische Methodologie, sondern in allen halbwegs problematischen Fällen darüber hinaus durch "außerjuristische" bzw. moralische Wertungen gesteuert wird.
