Seit dem 11. September 2001 ist der internationale Terrorismus und insbesondere das Phänomen des Selbstmordattentats in das allgemeine Bewusstsein gelangt. Schon bei den Erklärungsversuchen, die unmittelbar auf das Ereignis vom 11. September folgten, wurde unter anderem auf die „Theorie des Partisanen“ von Carl Schmitt aus dem Jahr 1963 zurückgegriffen. Die Schmitt’sche Schrift bot sich dafür an, weil sie den Partisanen als einen irregulären Kämpfer theoretisch zu erfassen versucht und auch der Terrorist ein irregulärer Kämpfer ist. Beide, Terrorist und Partisan, sind Akteure des ‚Neuen Krieges‘, der sich dadurch auszeichnet, dass nicht mehr Staaten gegen Staaten kämpfen, sondern parastaatliche oder auch private Akteure zunehmend an die Stelle der Staaten treten. Gemeinhin wurde die „Theorie des Partisanen“ herangezogen, um die Unterschiede zwischen dem Partisanen und den islamistischen Terroristen herauszustellen.
